The firm has prosecuted and defended a broad range of complex commercial and business related disputes, including contract, business tort, real property, landlord/tenant, creditors rights, employment, trade secrets/proprietary information, insurance coverage and collections/fraudulent conveyance claims in state and federal courts. By way of example, we recently:
Successfully prosecuted a fraudulent conveyance and breach of fiduciary duty claim on behalf of a leading furniture manufacturer resulting in the entry of a judgment in the amount of $692,000.00. The case involved a scheme to defraud creditors by siphoning off the equity in real property through a series of transfers, transactions and collusive legal proceedings.
Successfully defended a prominent local sports agent in a dispute over the payment of a commission for the signing of pitcher Orlando "El Duque" Hernandez with the New York Yankees. The lawsuit involved claims for breach of contract and tortious interference with an advantageous business relationship. After a 5 day trial in federal court, the jury returned a verdict of no liability, finding that the client had not breached the contract.
Successfully prosecuted a claim under a life insurance policy on behalf of the estate of the decedent policy owner resulting in the entry of a judgment in excess of $950,000.00 against the life insurance company that had issued the policy. The company had denied the claim, taking the position that the policy had lapsed and there was no coverage in effect at the time of the decedent's death because premiums had not been paid for 7 months. After a three day trial, the jury rejected the defense of the company and entered a verdict in favor of the estate, finding that the insurance company was responsible for the claim.
